Five3 Genomics, LLC ("Five3") is an innovative genomic research organization that seeks to revolutionize healthcare through its various products and services, including Genomics Analysis Services. Five3's mission is to improve the quality of health care through empowering physicians with a meaningful interpretation formulated from the complex genomic landscape of each patient's disease.

Five3 is committed to respecting and protecting your privacy. We want to give you the security and confidence you need to fully participate in our web-based offering so that we can better serve your needs. This Privacy Policy details our approach to privacy and how we collect, use, disclose, and protect your personal information. By agreeing to this Privacy Policy, you agree that we may collect, use, and disclose information about you as set forth herein, Your agreement and participation are always voluntary and you may ask us to delete your information as described in this Privacy Policy.

Definitions

For purposes of this Privacy Policy, we use the following definitions:

  • "Identifying Information" is information that can be used to identify you. Identifying information may include your name; address; elements of dates (except year) for dates directly related to you, including birth date, admission date, discharge date, date of death; and ages over 89; telephone numbers; fax numbers; electronic mail addresses; social security numbers; medical record numbers; health plan beneficiary numbers; account numbers; certificate/license numbers; vehicle identifiers and serial numbers, including license plate numbers; device identifiers and serial numbers; Web Universal Resource Locators (URLs); Internet Protocol (IP) address numbers; biometric identifiers, including finger and voice prints; full face photographic images and any comparable images; and any other unique identifying number, characteristic, or code that identifies you.
  • "Health Information" is any information that relates to your past, present, or future physical or mental health or condition; the provision of health care to you; or the past, present, or future payment for the provision of health care to you and which includes Identifying Information.

How We Secure and Protect Your Information

We protect the confidentiality of your Identifying Information and your Health Information by using industry standard firewalls and security protocols set up in our hosted server environment. Identifying Information and Health Information are encrypted using industry standard encryption algorithms while in transit. We secure and encrypt the Identifying Information and Health Information while at rest using applicable physical data security models within our data center. We use physical, administrative, and technical safeguards and security measures to protect your Identifying Information and Health Information. We encrypt all Identifying Information and Health Information with secure socket layer (SSL) transport protocol while in transit. This encryption means that your Identifying Information and Health Information is protected while transferred over the internet to our servers. Once your data reaches our servers, the same state-of-the-art security software that guards Five3's most essential business data also protects your Identifying Information and Health Information as well. Our servers are located in securely locked buildings that are protected by security alarms, guarded entry, and other physical security safeguards and measures. We have adopted internal information security policies and procedures that incorporate defense in depth principles to protect your information. While no system can guarantee absolute security, and we are not responsible for the illegal acts of third parties outside of our direct control, we have employed security measures that are generally recognized within our industry as reasonable practices for this information classification.

Information We Collect and How We May Use It

By agreeing to this Privacy Policy, you agree that we may collect, combine, and use your Identifying Information and Health Information in the following ways:

  • Information from you.
    We may collect Identifying Information and Health Information that you choose to share with us. We use this information in our protected systems to perform data analytics and informatics in order to analyze genomes you have provided to us. This process is intended to be fully automated, and to the extent physician interpretation or other non-automated intervention is required, we perform such intervention in accordance with a "minimally necessary" standard, meaning that such non-automated intervention will be the minimum necessary.
  • Information from healthcare organizations.
    With the appropriate authorization or agreements in place, we may also securely collect Identifying Information and Health Information that you have provided to your healthcare organization, employer health plan, insurer, or other third party selected by your healthcare organization, employer health plan, or insurer. We provide our services in furtherance of the healthcare operations of such healthcare organizations and their third parties.
  • Information from a Personal Health Record.
    If connection to a personal health record ("PHR") such as Dossia, HealthVault, or Google Health, is offered by your healthcare organization, employer, insurer, or other third party, and if you sign up for this service, we may also collect Health Information and Identifying Information that you have stored in that PHR if you choose to enable it and thereby authorize us to collect it.
  • IP Addresses.
    An IP address is a number automatically assigned to your computer whenever you access the internet. IP addresses allow computers and servers to recognize and communicate with each other. We may collect and log portions of the IP address of visitors to our web-enabled services so that we can properly administer our system and gather aggregate information about how our web-enabled services are being used.

How We May Share Your Information

By agreeing to this Privacy Policy you agree that we may share your Identifying Information or Health Information in the following manner:

Third Parties

We may share Identifying Information or Health Information with third parties whom we have engaged to help us store, process, and analyze such information with respect to your healthcare and operating our business so that we may continue to provide services to you, or any other services that you have requested directly or through your healthcare organization.

If you so choose, we can share your Identifying Information or Health Information with a replacement vendor if you elect to terminate our services. We may also share your Identifying Information or Health Information with any successor to the business of, or the purchaser of substantially all the assets of, Five3 Genomics, LLC.

We may share Identifying Information or Health Information with a PHR vendor if you have signed up for their service, and we will transmit your Identifying Information and Health Information to your PHR account if you choose to enable that feature via the PHR vendor.

We may share Identifying Information or Health Information with a third party if we believe that disclosure is necessary to conform to legal requirements or to respond to a subpoena, search warrant, or other legal process received by us. Additionally we may also share Identifying Information or Health Information solely when necessary to enforce our Terms of Use, to protect our rights, or to protect the safety of members of the public and users of the services.

Use of De-Identified Data

We may also de-identify your Identifying Information or Health Information and aggregate it with de-identified data from other users of the services in accordance with federal and state law. This de-identifed data may be used to provide general population health reporting to healthcare organizations, employers, insurers, or other third party clients such as federal or state agencies that are researching healthcare trends.

How We Use "Cookies" or "Web Beacons"

Like most web portals, we may use "Cookies" (small text files) and "Web Beacons" (tiny graphic image files embedded in a web page in GIP, jpeg, or HTML format, that provide a presence on the web page and send back to its home server information from your browser, such as the IP address) or other similar technology to provide us with anonymous information relating to the use of our web-based services. For example, we may use "Cookies" to help you navigate one of our web-based services more efficiently, and statistically monitor how many people are using our web-based services, track user requests and tailor the resulting user experience.

How We Update or Delete Your Information

You may request that your information be updated or deleted by contacting us at the physical address included at the end of this Privacy Policy. We will make efforts to update or delete Identifying or Health Information received from you as soon as possible. It is not technically possible for us to immediately remove from our servers every record of the information provided to us. The need to back up our systems to protect your information from inadvertent loss means that a copy of your information may exist in a non-erasable form for some limited time period before it is ultimately destroyed.

How We Protect Information of Children

Our web-based services are intended for a general audience, but are not designed to attract children under the age of 13 without full parental control, in compliance with federal and state law. We do not knowingly collect information from any person we actually know is under the age of 13, but parents or legal guardians of such minor children may be able to utilize the web-based services on their minor child's behalf.
